 New Passport Rules with effect from 26.12. 2016

 

            In order to streamline, liberalize and ease the process of issue of passport, the Ministry of External Affairs has taken a number of steps in the realm of passport policy which is expected to benefit the citizens of India applying for a passport. The details of these steps are given below:-

 

PROOF OF DATE OF BIRTH

             As per the extant statutory provisions of the Passport Rules, 1980, all the applicants born on or after 26/01/1989, in order to get a passport, had to, hitherto, mandatorily submit the Birth Certificate as the proof of Date of Birth (DOB). It has now been decided that all applicants of passports can submit any one of the following documents as the proof of DOB while submitting the passport application:

 

(i) Birth Certificate (BC) issued by the Registrar of Births & Deaths or the Municipal Corporation or any other prescribed authority whosoever has been empowered under the Registration of Birth & Deaths Act, 1969 to register the birth of a child born in India;

 (ii) Transfer/School leaving/Matriculation Certificate issued by the school last attended/recognized educational board containing the DOB of the applicant;

 (iii) PAN Card issued by the Income Tax Department with the DOB of applicant;

 (iv) Aadhar Card/E-Aadhar having the DOB of applicant;

 (v) Copy of the extract of the service record of the applicant (only in respect of Government servants) or the Pay Pension Order (in respect of retired Government Servants), duly attested/certified by the officer/in-charge of the Administration of the concerned Ministry/Department of the applicant, having his DOB;

 (vi) Driving licence issued by the Transport Department of concerned State Government, having the DOB of applicant;

 (vii) Election Photo Identity Card (EPIC) issued by the Election Commission of India having the DOB of applicant;

 (viii) Policy Bond issued by the Public Life Insurance Corporations/Companies having the DOB of the holder of the insurance policy.

 

REPORT OF THE INTER MINISTERIAL COMMITTEE

             A three-member Committee comprising of the officials of the Ministry of External Affairs and the Ministry of Women and Child Development was constituted to examine various issues pertaining to passport applications where mother/child has insisted that the name of the father should not be mentioned in the passport and also relating to passport issues to children with single parent and to adopted children. The Report of the Committee has been accepted by the Minister of External Affairs.

              The following policy changes have been made inter-alia on the basis of the recommendations of this Committee:

  i) The online passport application form now requires the applicant to provide the name of father or mother or legal guardian, i.e., only one parent and not both. This would enable single parents to apply for passports for their children and to also issue passports where the name of either the father or the mother is not required to be printed at the request of the applicant.

 (ii) The total number of Annexes prescribed in the Passport Rule, 1980, has been brought down to 9 from the present 15. Annexes A, C, D, E, J, and K have been removed and certain Annexes have been merged.

 (iii) All the annexes that are required to be given by the applicants would be in the form of a self-declaration on a plain paper. No attestation/swearing by/before any Notary/Executive Magistrate/First Class Judicial Magistrate would be henceforth necessary.

 (iv) Married applicants would not be required to provide Annexure K or any marriage certificate.

 (v) The Passport application form does not require the applicant to provide the name of her/his spouse in case of separated or divorced persons. Such applicants for passports would not be required to provide even the Divorce Decree.

 (vi) Orphaned children who do not have any proof of DOB such as Birth Certificate or the Matriculation Certificate or the declaratory Court order, may now submit a declaration given by the Head of the Orphanage/Child Care Home on their official letter head of the organization confirming the DOB of the applicant.

 (vii) In case of children not born out of wedlock, the applicant for the passport of such children should submit only Annexure G while submitting the passport application.

 (viii) In case of issue of passport to in-country domestically adopted children, submission of the registered adoption deed would no longer be required. In the absence of any deed to this effect, the passport applicant may give a declaration on a plain paper confirming the adoption.

 (ix) Government servants, who are not able to obtain the Identity Certificate (Annexure-B)/ No-Objection Certificate (Annexure-M) from their concerned employer and intend to get the passport on urgent basis can now get the passport by submitting a self-declaration in Annexure-‘N’ that he/she has given prior Intimation letter to his/her employer informing that he/she was applying for an ordinary passport to a Passport Issuing Authority.

 (x) Sadhus/ Sanyasis can apply for a passport with the name of their spiritual Guru mentioned in the passport application in lieu of their biological parent(s) name(s) subject to their providing of at least one public document such as Election Photo Identity Card (EPIC) issued by the Election Commission of India, PAN card, Aadhar Card, etc wherein the name of the Guru has been recorded against the column(s) for parent(s) name(s).

             The above changes in the Passport Rules have been brought by the Government of India to further ease the process for passport applicants for getting their Passport in a timely, transparent, more accessible, reliable manner and in a comfortable environment through streamlined processes and committed, trained and motivated workforce.

ONLINE PASSPORT APPLICATION:

 

            The Government of India has introduced Machine Readable Passports (MRPs). Under this system, passport applicants living/working in Brunei should apply online on the web site: https://portal6.passportindia.gov.in/Online/index.html .  After filling in the details, a Web File Number like BRNDI0000123 etc, and an application form will be generated on screen and can be printed by the applicant, which becomes the application form. In case, applicants are unable to get the print out of the filled up form due to any reason, the same can be printed later by entering the Web file Number and Date of Birth.

             The printed application form along with required documents and fee may be submitted at the Consular Section of the High Commission of India, Brunei Darussalam from where it will be sent for printing to the Central Processing Centre of the Ministry of External Affairs, New Delhi as the High Commission does not have facilities for printing Machine Readable Passports. After printing the passports in New Delhi, these are received by the High Commission for by courier. These passports are signed by the authorized signatory at the High Commission and delivered to the applicants. This process takes 2-3 weeks. All applicants are therefore, advised to submit their passport applications at least one month in advance of before the date of travel to avoid any inconvenience.

             However, in case of emergency, the Mission may consider to issue Emergency certificate for travel to India only. The same need to be re-applied subsequently for machine readable passport by applicant on reaching India at the nearest Passport Issuing Authority.

IDELINES FOR ONLINE REGISTRATION:

             As mentioned above, NRI Passport Applicants need to apply for Passport Services using Online Registration. This facility for NRIs is available on https://portal6.passportindia.gov.in/Online/index.html. Only the residents falling under the jurisdiction of the High Commission of India, Brunei are eligible to apply online through this website. This service is not rendered to Indian nationals who are on visit visa or business trip. The applicants need to have valid work permit/ residence permit, a copy of which should be attached with the application.

             You can apply online for a fresh passport (only in case of minors at birth), re-issue of passport (if your present passport of 10 years validity has expired / will expire in next 6 months or the pages are full), duplicate passport (if your present passport is lost or damaged).

             Please don't use special characters while entering details in the online registration form. The dates can be entered as per the format given in the website (DD/MM/YYYY). Through this site you can register your application from Brunei Darussalam (Country name in the drop box). After all details are filled in, click "SAVE" to get the file number and also the option to take the print out of the application form. If you are not able to print the application form for any reason, you can get the copy of the already registered application using the "REPRINT FORM" option by entering the file number. With the help of the file number and date of birth you can re-print the application form later.

Surname is usually the last name or family title. Therefore, please enter your last name such as Iyer, Rao, Nair, Sharma etc. In case you do not have surname, just write the given name

Enter the name as it appears in your passport. Makes sure to enter   it correctly without making any mistakes, no abbreviation should be written and it should be expanded

If you have ever changed your name, please indicate the previous name in full. This will be applicable to a person who has changed the name, or a lady who has changed her name/ surname subsequent to marriage

Enter in the format of DD/MM/YYYY.

If born in India, please mention the name of village/town/city/state in India. If born outside India, mention the name of place and country. If you have held a passport or currently hold a passport, give details of previous passport including File number  which is generally given on the last cover page of the passport.

CONTACT INFORMATION (to be written after taking a print out)

 

Please fill up the details carefully with complete postal address, telephone number, mobile number and email address. Please give at least one phone number in Brunei (preferably mobile phone number).

After completing the online application, click “Save”.

Files which are registered online successfully for processing at High Commission of India, Brunei will carry the file number BRNDI0000123 etc .

Take a print of the data registered online. This will have a total of four (4) pages. Page one and items 5, 6, 8 and 10 (on page two) are already completed by the online application form. You are required to fill rest of the form (items on page 2, 3 and 4) by hand in capital letters. At the beginning of the application form, please paste one photograph, add your signature in the space given, and thumb impression in case of child who cannot sign. DO NOT sign across the photograph.

PHOTOGRAPHS

Four colour photographs in matt version (not glossy) (size 5 x 5 cm, or 2” x 2”) with white background (preferably of contrast dress) and frontal face view should be of high quality, with sharp focus and clear image since it is required to be scanned and printed on the passport. Photographs that do not conform to these requirements will be rejected and may cause a delay in processing the applications.

Black and white photographs, photographs with coloured or dark glasses, dark background or in uniform, polaroid prints, glossy photographs, or computer prints will not be accepted.

SIGNATURE / THUMB IMPRESSION

Signature/thumb impression should be strictly within the box without touching the boundaries. Sign within the box provided for it on the first page. Sign below item -26 (page-3) as a declaration. Sign in the two boxes at item-29 on the page-4 (last page) as specimen signature. If your child cannot sign, you should affix his/her thumb impression in the boxes appearing on page-1 and page-4 (last page) of the application.  Thumb impression should be of left hand in case of males, and right hand in case of females. Parents should NOT sign inside any of the boxes.

Important Note: all original documents are to be shown at the time of submission of the passport application form and self attested copies of all required documents are to be attached with the application.

When you receive the new passport, your old passport will be cancelled and returned to you. Visas if any, in the old passport are still valid until the date of expiry. You will have to carry both the passports together for travel using the visa in the old passport. Some of the countries insist that the visa be transferred on the current passport for which please contact the concerned embassies before you travel to such countries.

It is the responsibility of the individual to check the status of his/her passport in case of any delay and collect the passport in time. Old passports should be submitted for cancellation while collecting the new passports. If cancelled passport contains valid visa, it can be carried with the new passport.

CHILD PASSPORT / REGISTRATION REQUIREMENT

·  Duly filled Passport Application Form registered online.

·  Form of Registration of birth of the newly born child in duplicate.

·  Original Passports with photocopy of relevant pages of both parents.

·  Original birth certificate and photocopy issued by the Brunei Government.  Name of the parents should be same as in the Birth Certificate of the Child.

·  Child born in Brunei needs to be registered in the Indian Mission within one year of the child’s birth.  In case the child is above one year, the case will be referred to the Ministry of Home Affairs, Government of India for clearance.

 

DOCUMENTS TO BE ATTACHED

 For re-issue of a passport:  

   ·      Old passport in original with self-attested photocopy of its first two and last two pages including the address.

·      Residence permit/stay permit of Brunei with a copy  

·      If there is any change in address, attach one of the following documents:  Applicant’s Aadhar Card/ Election Photo Identity Card (EPIC) issued by the Election Commission of India/ PAN card / driving license/ Latest  Bank passbook/ ration card.  In case of  minor, copy of  minor’s passport, copy of one of the parent’s passport and residence/work permit.

             Applicants can submit passport application, completed in all respects with relevant enclosures at the Consular Section of the High Commission of India, Brunei on working days (Mon – Fri) between 09:30 to 12:30 hrs.

 

GENERAL INFORMATION FOR APPLICANTS:

 

            Your passport is a valuable document. It should always be either in your own custody or in the custody of a person duly authorized by you. Passports should not be sent out of the country of residence by post. If lost or destroyed, the fact and circumstances should be immediately reported to the nearest Indian Mission and the local police.It is an offense under the Passports Act 1967 to give false information in the Application. Passport facilities can be denied on grounds of suppression of factual information, submission of false particulars, willful damage of passport and for making unauthorized changes in the passports.

             Your passport can be impounded or revoked by the Government of India under the provisions of the Passports Act 1967 in which case, you will be required to surrender the passport to the nearest Indian Passport authority.

             If you have acquired Brunei Citizenship, please surrender the Indian passport to the High Commission of India, Brunei. The Indian passport is returned to the applicant after cancellation and a Surrender Letter is issued. The cancelled Indian passport should be kept in safe custody with you as it may be required at the time of applying for the OCI card.

 Incomplete/false information:

             Print out of online application forms should be filled in fully, accurately and submitted with the passport. The application must be signed by the applicant himself. Misrepresentation/ suppression of the facts may result in denial of passport/consular service. Incomplete/incorrect applications, applications with inadequate fee and the fee not paid in the prescribed manner will be returned without any service. Without these details, the issue of a passport may get delayed. Please keep a photocopy of your passport in a safe place. It may take more time to process the passport application in case where the clearance is awaited from Other Indian Missions/ Passport Offices.

 NOTE: These are general guidelines. In case of any other requirements that are needed to be fulfilled by the applicants, the same will need to be provided. Frequent travellers are advised to keep  scanned copies of all pages of their passport, visa, stay permit, local ID cards etc and store them on their personal USB flash drives, external hard drives, laptops or on their email addresses for easy access in case of loss or misplaced travel
